If a defendant has pled guilty or been found guilty after trial, and even if an appeal has been lost, there may be additional remedies available through post-conviction litigation.  These claims often entail ineffective trial or sentencing counsel, government suppression of favorable “Brady” evidence, or the discovery of new evidence of innocence.  Throughout his career, Firm Partner Benjamin Waxman has filed such claims in both federal and state courts.   He has been successful in vacating serious convictions arising from both pleas and trials, and life and lesser sentences imposed based on these convictions.
